Welcome to Hoorah Online Pty Ltd (“Hoorah Online”, “we”, “our”, or “us”).
These Terms of Service (“Terms”) govern your use of our website (hoorahonline.com.au), subscription services, digital marketing, and related products (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.


1. Eligibility

You must be at least 18 years old and capable of entering into legally binding agreements to use our Services. By using our Services, you represent and warrant that you meet these requirements.

Hoorah Online provides:

  • Website design, hosting, and maintenance.
  • Search Engine Optimisation (SEO).
  • Google Ads & Meta Ads management.
  • Email & SMS marketing.
  • Other related digital marketing and software services.

Details of each Service, including pricing, inclusions, and exclusions, are outlined on our website or in your service agreement.


3. Accounts

You may need to create an account to access certain Services. You agree to:

  • Provide accurate, complete, and current information.
  • Maintain the security of your login credentials.
  • Notify us immediately if you suspect unauthorised access.
    You are responsible for all activity under your account.

4. Payments & Billing

  • Services are billed on a subscription or project basis, as displayed at checkout or in your agreement.
  • Payment is due in advance of service delivery unless otherwise agreed.
  • By providing payment details, you authorise us to charge your chosen method on a recurring basis (if applicable).
  • All fees are quoted in AUD and inclusive of GST unless stated otherwise.
  • Late or failed payments may result in suspension or termination of your Services.


5. Cancellations & Refunds

  • You may cancel subscription Services at any time via your account or by contacting us.
  • Cancellation takes effect at the end of your current billing cycle; no partial refunds are provided unless required by law.
  • Certain Services may require a minimum term (clearly disclosed at sign-up).
  • Refunds are only available where required under the Australian Consumer Law or as otherwise stated in writing.


6. Client Responsibilities

By using our Services, you agree to:

  • Provide accurate and timely information, access credentials, and approvals required for delivery.
  • Ensure you have the necessary rights to any content, images, or data you supply to us.
  • Comply with applicable laws, regulations, and platform policies (Google, Meta, etc.).
  • Not use our Services for unlawful, abusive, or fraudulent purposes.


7. Intellectual Property

  • All materials created by Hoorah Online (websites, designs, campaigns, reports, etc.) remain our intellectual property until full payment has been received.
  • Upon full payment, you are granted a non-exclusive, non-transferable licence to use the deliverables for your business.
  • You may not copy, modify, distribute, or resell our materials without written consent.


8. Third-Party Services

Our Services may integrate with third-party platforms (Google, Meta, Shopify, Duda, Klaviyo, etc.).

  • We are not responsible for downtime, errors, or changes in third-party policies.
  • Your use of such services may also be subject to those providers’ terms and policies.


9. Disclaimer of Warranties

While we aim to deliver high-performing results, we do not guarantee specific outcomes (e.g., sales, rankings, ad performance).
Our Services are provided on an “as-is” and “as-available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied.


10. Limitation of Liability

To the fullest extent permitted by law:

  • Hoorah Online is not liable for indirect, incidental, or consequential damages.
  • Our total liability for any claim is limited to the amount you paid for the Services in the three months preceding the claim.
    Nothing in these Terms excludes liability under the Australian Consumer Law that cannot be excluded.



11. Termination

We may suspend or terminate your access if you:

  • Breach these Terms.
  • Fail to pay for Services.
  • Engage in unlawful or harmful activities.

You may also terminate at any time by providing written notice, subject to Section 5 (Cancellations).


12. Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect and handle personal information.


13. Changes to These Terms

We may update these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of our Services after changes constitutes acceptance of the new Terms.


14. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
